Terms and Conditions of Use - Students

The user of Learncafe, whether student or author, duly identified when registering on the website www.learncafe.com, for all necessary purposes, declares to be aware of and agrees to adhere to the terms specified below, and must comply with all provisions that are part of this EDUCATIONAL SERVICES PROVISION AGREEMENT to be signed between Learncafe and the user registered as a student enrolled in any of the courses, as well as the authors of said courses, at the moment of their acceptance. A student is considered any user registered on Learncafe who acquires and effectively takes one of the offered courses, whether free or not. An author is considered any user registered on Learncafe who makes a course available to interested parties, being their sole, unrestricted, and exclusive responsibility the authorship, truthfulness of information, content, compliance with national legislation, especially the Copyright Law, and other considerations related to the course made available.

To students and interested parties:

  1. Support for the course content (tutoring) by the teacher is not mandatory, but when offered, it must be done solely and exclusively by the respective teacher, who is also responsible for providing communication options such as email, messaging, communicators, telephone, and/or others.

  2. When the course is not free, the registration payment must be made by the student under penalty of restriction of access to the course content.

  3. Learncafe will never charge the student additional fees, monthly fees, or any other amounts for registration in already paid courses without prior notice and authorization.

  4. Registration in free courses is exempt from hidden fees or monthly charges. If Learncafe offers any additional paid service, it will be optional, and it is up to the student to pay or not for the use of the service, without any obligation.

  5. The student will not pay any amount other than that provided for the registration fee, which allows the student online access to the full desired course until the expiration date, as informed by the teacher.
     
    1. Access to free courses provided by Learncafe is granted through sharing on social networks Facebook or Twitter, or by sharing via email to your contact list (Gmail, Yahoo, Outlook, or Hotmail). The user understands that access to the profile and contact list is necessary to perform the sharing, requiring authorization to access their account so that Learncafe can send invitations on their behalf, always duly identified (or on behalf of Learncafe itself).

  6. At the end of the course, the student may acquire the electronic certificate in PDF with a location code issued by Learncafe (which will prove the student's completion of the course) ONLY IF our pedagogical proposal is fulfilled. The digital certificate will only be available for download after calculating a maximum of 12 daily study hours based on the total course workload, AND having completed at least 20% of this same workload, respecting the deadlines and limits for certificate issuance.

    1. Completion certificates issued by the student for courses taken on our platform are valid for 1 (one) year from the course completion date. After 12 months, the certificate will be marked as "expired" and will no longer be valid, and the student must refrain from using it.
       
    2. The registration fee for courses does not include certificate issuance, and it is necessary to purchase certificates separately. Thus, a student who completes a course and wishes to obtain the completion certificate (digital or printed) must proceed with the purchase for subsequent issuance.
    3. Digital certificates and printed certificates are distinct products and services, so purchasing one does not entitle the buyer to the other, and it is necessary to acquire separately digital or printed certificates.

  7. Learncafe does not allow the student to study simultaneously one, two, or more courses in which they are enrolled. This means the student must keep only one browser tab open with content to be studied. This is important so that the proper accounting of study hours occurs; otherwise, the student will be automatically prevented from continuing studies if more than one tab with lessons is detected.

  8. The digital certificate offered is not sent by mail, is not printed by Learncafe, and does not have notarized authentication or signature recognition; it is a document made available digitally for printing by the student themselves, upon separate purchase from the course registration fee.

  9. The student must use forums, glossaries, and other resources provided by Learncafe exclusively for didactic purposes, aimed at their training and benefit, without using spam, offensive language, or referring to subjects unrelated to the course objectives, under penalty of being fully and exclusively responsible for any judicial or extrajudicial measures taken against their publications.

  10. It is expressly forbidden for the student to save, copy, print, or disclose the content of courses in which they are enrolled, or pass it on to third parties, except with express written permission from the responsible teacher/author of the course or within the limits permitted by law.

  11. The student declares to know the terms of the current copyright legislation and further informs that they will not use, reproduce, or disclose any intellectual or copyright material of third parties, under penalty of being exclusively and fully responsible, under Brazilian law, for any copyright violation and judicial and/or extrajudicial actions arising from such violations, filed by anyone, including but not limited to possible authors, publishers, and other interested parties.

  12. All course content is the exclusive and full property and responsibility of the teacher/author, so any doubts the student may have should be directed to the course teacher/author, who may, if able, respond directly to the student through mechanisms provided on the Learncafe website. We emphasize that tutoring by the teacher is not included in the course price and is an optional, non-mandatory service by each author.

  13. The student must treat the teacher and all other participants on the Learncafe website respectfully and courteously.

  14. The fee charged for registration in non-free courses does not imply consulting, support, or any other interference responsibilities by Learncafe, and any act that depends on contact with the teacher (course author) is optional and exclusively the teacher's responsibility, with Learncafe not being responsible if the teacher does not respond or if the contact is made without the student's consent.

  15. Learncafe users may not publish profanity or content offensive to third parties, as well as racist, immoral, illegal, defamatory content, offensive to good morals, and others of the same nature, under penalty of account cancellation and other measures the offended party may take, with Learncafe having no responsibility for the published content.

  16. Learncafe users must maintain their own profile by registering on Learncafe, committing and being responsible for the truthfulness of the information contained therein, under penalty of legal sanctions. Learncafe reserves the right to alter information filled in by the user whenever it deems necessary to correct or delete incorrectly or falsely filled fields.

  17. Learncafe is not an entertainment portal; it is an online educational services channel exclusively aimed at educating and improving the knowledge of its users.

  18. Learncafe reserves the right to suspend and/or delete users, courses, certificates, students, and teachers without prior notice in case of non-compliance with the rules established here or current legislation, with no compensation, reimbursement, or damages payable to any infringing party.

  19. The student is not authorized to carry out financial transactions, refunds, or donations to any other Learncafe users, including teachers, students, or other user profiles.

  20. Learncafe is not responsible for the content of messages published by users, who are solely and exclusively responsible for what they publish in various communication channels offered, such as message boards, forums, chat, questions, evaluations, and others, fully and exclusively responding to any judicial or extrajudicial measures taken against their publications. However, Learncafe may delete or edit messages that contain incorrect or false information.

  21. The user understands that Learncafe pages are accessible through search engines and may locate pages with usernames and/or published courses; removal of personal data and other user information must be requested directly through web services provided and is not the responsibility of Learncafe.

  22. The user understands and authorizes the publication of comments and evaluations made by them regarding the courses taken.

  23. Courses published on Learncafe have an access period; it will not be possible to complete studies after the period expires. After the access period to the lessons expires, it will be necessary to renew enrollment by paying a new registration fee.

  24. The student understands and accepts that Learncafe is a portal for non-formal courses only, and there are no courses with diplomas at technical, undergraduate, bachelor's, teaching degree, postgraduate, master's, or doctoral levels, even if these are mentioned in their titles or descriptions.

    1. The course title and other related information are the sole and exclusive responsibility of the teacher/author responsible for feeding the site and making the content available.
       
    2. Learncafe reserves the right to rename courses and descriptions at any time without prior notice, as well as other course metadata.
       
  25. The student understands that the workload (course duration) when manually filled in by the teacher may not correspond to the offered content; in such cases, the student commits to contacting the COURSE TEACHER/AUTHOR. The student also commits not to use the certificate of the said course under any circumstances, knowing that when the duration or other course-related information does not reflect the reality of the offered content, the certificate becomes false/invalid.

  26. The student must also contact Learncafe when the workload (course duration) manually filled in by the teacher/author does not correspond to the offered content for necessary measures, including but not limited to warning the teacher/author for proper correction of the workload. If the warning is not heeded by the teacher/author, Learncafe may suspend/delete the course presenting such incompatibility, as appropriate, with no compensation, reimbursement, or damages payable to the teacher/author.

  27. If there is a discrepancy between the content informed by the teacher/author and the content actually published, the student may request a refund of the amounts invested in the contracted educational services, a request that will be analyzed by Learncafe and subsequently refunded or not, as the case may be. If a refund is recognized, Learncafe will contact the student to collect bank data and necessary information.

  28. The student understands that courses with excessive workload may have their duration informed by the teacher/author altered without prior notice.
     
  29. The student understands that they may only take one course at a time; it is not allowed to take two or more courses simultaneously. The student may enroll and start more than one course at a time but may only count study hours in a single lesson of a single course at a time; simultaneous counting is not allowed. This measure is necessary for the student to make better use of their studies, aiming to guarantee the quality of our services and maximize the validity of our certificates.
     
  30. The student understands that they may only take one free course at a time, with a current grace period of 120 days before taking another free course. The grace period for taking new free courses may vary for more or fewer days without prior notice.

  31. The student understands that free courses made available from the "Learncafe Youtube Courses" profile are registered by our internal team from Youtube playlists that have an embedding option, where we reference access links to the channel and all copyrights. We provide the content free of charge as knowledge dissemination. Thus, the student also understands that this free content may be taken down at any time without guarantees or rights to the student(s).
     
  32. The digital completion certificate in PDF will be available for download for two months after course completion. After this period, Learncafe will not provide new copies of certificates (issued or not).

  33. Users must also have, at their own risk, all equipment and software necessary for internet access, as well as applications, plugins, and extensions needed to view content in its various formats, such as Adobe Flash Player and Adobe Reader plugins, as well as have a permanent and valid email address for contact with Learncafe. It is the user's sole responsibility to keep Learncafe's database updated, and Learncafe will not be responsible for incorrect filling or providing inaccurate or wrong information, nor is Learncafe responsible for any measures to collect or seek new registration data. Compensation, reimbursements, and damages are also not due.

    1. The Learncafe access password is chosen and solely the responsibility of the user, and it is recommended not to use the same password in other environments, applications, or websites on the internet. This is an important security measure to prevent data leaks from third-party sources.

  34. The student understands that, in case of profile deletion on our platform, certificates of completed courses will be automatically invalidated. It is also understood that, in case of course withdrawal, deleting it from the profile will equally invalidate the certificate.
     
  35. Starting September 2015, Learncafe offers certificate printing requests. The student is hereby aware that this service has an additional (optional) fee for production and delivery, not included in the course registration fee. Printed certificates are optional and can be purchased respecting postal delivery times and production and payment confirmation deadlines.
     
  36. In case of dissatisfaction with the course content, the student may request a refund if they have not completed more than 40% of the course content and have made the refund request within a maximum of 7 days from the course registration date.

    1. Refunds will not be allowed if the student has completed the course.

    2. Refunds will not be possible if the student has issued or downloaded the completion certificate.
        
  37. In accordance with item 31 of this document, the student understands that contact with Learncafe will be exclusively via email, with [email protected] or our contact form as the support channels provided. Our social networks such as Facebook, Twitter, Instagram, Blog, and others are not proper means for support and therefore cannot be used for this purpose. Our support operates Monday to Friday, from 09:00 to 18:00, except on holidays and extended holidays, and our response time is 24 business hours from the time of receipt of your request.
      
  38. The user understands that Learncafe servers are configured with Greenwich Mean Time (GMT), which means some date and time information will differ by UTC-3:00 compared to Brasília time; however, timezone settings do not affect the determination of facts, access deadlines, or expiration.   39. In September 2017, Learncafe began its internationalization process, making the platform available in other languages, countries, and currencies. Regarding this, even though course prices in Brazilian Portuguese are displayed in other currencies (such as dollar, euro, pound, or peso), payment methods will charge based on the value in Brazilian real (BRL).
     
  40. On November 21, 2018, we started offering subscription plans to our students, providing them with the option of monthly or annual recurring payments for access to all courses available in a given plan.
  41. Access to course content for registrations made through a subscription plan will be guaranteed as long as the subscription period lasts; however, in case of default, access to these courses will be suspended—regardless of the expiration date—until the outstanding amount is paid.

  42. While the student's subscription is active, they will have full access to courses belonging to the chosen plan. To check the courses included in a specific plan, visit the plan page and request to list all available courses.

  43. Subscription to a plan can be canceled at any time, respecting the Consumer Defense Code (CDC). Additionally, refund (or chargeback) requests must be made within 7 calendar days, during which no course should have been completed.

  44. "Plan cancellation" means suspending future monthly or annual recurring charges for using that plan. Whenever the student requests cancellation, we will process the request at the end of the current billing period, with no new charges for that plan.

  45. Each subscription plan has its own list of courses to which the subscriber will have access. Access to courses not included in the respective plan is not allowed. If the student is interested in other courses not covered by the chosen plan, they must register individually or subscribe to another plan.   46. Starting January 2020, Learncafe offers digital certificate purchase requests. The student is hereby aware that this service has an additional (optional) fee for obtaining certificates for completed courses, not included in the course registration fee. Digital certificates are optional and can be purchased respecting pedagogical conditions, terms and conditions, and payment confirmation.

  47. Learncafe guarantees certificate issuance within 30 days after course completion. This means that although certificate issuance is possible immediately after finishing studies, the student understands that deadlines and commitments for presenting the certificate are at the student's own risk, even if technical or accessibility difficulties occur in issuing the certificate on our platform. Learncafe should not be held responsible for the uses and obligations the student intends to make of the certificate.

  48. Before registering and using our certificates, one should consult the regulations of each selection process, contest, or interview to ensure that certificates issued by Learncafe will be accepted. Each institution has its own rules regarding acceptance and use of completion certificates for non-formal courses, and Learncafe is not responsible for any refusals or internal procedures of third parties.

 

The parties elect the court of the District of Belo Horizonte, State of Minas Gerais, as competent to settle any disputes arising from these Terms of Use, regardless of any other, however privileged it may be or become.
